Confidentiality, Privacy Policy and Terms and Conditions

1. Client Agreement and Scope of Services

This agreement sets out the terms and conditions for the counselling services, group therapy, self-paced courses, professional training and other support offerings provided by Amanda Westphal Counselling.

By booking, purchasing or accessing any service, course or offering, you confirm that you have read, understood and agree to these terms.

All services are provided in accordance with applicable Australian laws, the Code of Conduct for Health Care Workers issued by the ACT Human Rights Commission, and the Code of Ethics and Practice of the Australian Counselling Association (ACA).

2. Practitioner Standards and Codes of Conduct

Amanda Westphal is a counsellor and a member of the Australian Counselling Association (ACA). Counselling is not a registered profession under AHPRA. As an unregistered health care worker, Amanda Westphal Counselling operates in accordance with:

  • the Code of Conduct for Health Care Workers, issued by the ACT Human Rights Commission
  • the ACA Code of Ethics and Practice

If you have a concern about the service you have received, you are welcome to raise it directly with Amanda Westphal Counselling in the first instance. You may also contact the ACT Human Rights Commission or the ACA.

Amanda Westphal is a counsellor, not a registered psychologist. Counselling services are not eligible for a Medicare rebate. Some health funds offer rebates for counselling under extras cover. Check your eligibility with your provider before booking.

3. Confidentiality and Privacy

All personal information and disclosures shared in counselling sessions are treated as confidential, except where:

  • there is immediate risk of harm to yourself or another person
  • disclosure is required by law, including mandatory reporting obligations
  • information is shared for professional supervision, with identifying details protected where possible
  • emergency intervention is reasonably necessary for your safety

Confidentiality does not extend to group settings where other participants are present. Everyone taking part in a group session is expected to protect the privacy of other participants.

4. Group Therapy and Community Rules

This section applies to PMDD Group Therapy and any other group or community offering. Participants must:

  • keep what is shared by other participants confidential
  • not record sessions, calls or group discussions
  • communicate respectfully
  • not engage in bullying, harassment, discrimination or other abusive conduct

A breach of these rules may result in removal from the group without refund.

5. Session Bookings, Attendance and Cancellations

This section applies to 1:1 Counselling Sessions and PMDD Group Therapy. Bookings are made through the booking links published at amandawestphal.com.au.

Please join on time. If you have not arrived within 15 minutes of the scheduled start time, the session will be treated as a non-attendance and charged in full.

A minimum of 24 hours' notice is required to cancel or reschedule a session. Late cancellations and missed appointments are charged at the full session fee.

Emergency rescheduling may be offered at Amanda Westphal Counselling's discretion.

6. Current Services and Offerings

Amanda Westphal Counselling currently offers:

1:1 Counselling Sessions

Private, 50-minute sessions delivered by secure video, tailored to your cycle and drawing on DBT, ACT and IFS. $175 per session. Health fund rebates may be available under extras cover; check with your provider.

PMDD Group Therapy

Live, small-group sessions with women who understand PMDD, informed by DBT and ACT. Ongoing. $45 per session.

The PMDD Reset Course

A self-paced, six-module course including the Luteal Life-Saver Journal and the PMDD Episode Toolkit, drawing on DBT, ACT and Internal Family Systems. Lifetime access. $455 one-time.

Rage Rescue

A guided, two-part audio session to help manage PMDD-related anger. Lifetime access. $27 one-time.

PMDD Informed: Allied Health Training

Self-paced training for allied health professionals who want to better recognise and support PMDD in their own clients. $397 one-time. This training is educational content for practitioners. It is not counselling, and it does not create a counsellor-client relationship between Amanda Westphal Counselling and the professional's own clients.

Free Monthly PMDD Support Guide

A free resource including a symptom tracker, cycle-phase map and journal prompts, provided in exchange for your email address.

Prices are in AUD and correct as at the date of this update. Current prices are always listed at amandawestphal.com.au. Amanda Westphal Counselling may add, remove or change services, formats and prices at any time.

7. Digital Products and Intellectual Property

All materials connected with these services, including course content, worksheets, the Luteal Life-Saver Journal, the PMDD Episode Toolkit, the PMDD Reset Method framework, training content, audio, video, recordings and branding, are the intellectual property of Amanda Westphal Counselling.

Purchasing or accessing a course, program or training gives you a personal licence to use the content for your own use only. You may not copy, reproduce, teach, resell, distribute, repurpose or create derivative works from this content, or share your login, downloads or materials with any other person, without prior written consent.

A breach of this section may result in termination of access without refund, and may be enforced further where necessary.

8. Payments and Financial Responsibility

All fees are payable in AUD.

Failure of payment does not cancel your financial obligation. If a payment fails, access may be suspended, outstanding balances remain payable, and collection action may be taken where necessary.

9. Refunds and Consumer Rights

Due to the digital and service-based nature of these offerings, refunds are not provided for change of mind. This includes missed sessions, forgotten bookings, and lack of engagement with course or training materials.

Refunds are provided where required under Australian Consumer Law. Nothing in these terms excludes your non-excludable rights under the Competition and Consumer Act 2010 (Cth).

10. Crisis and Emergency Support

Amanda Westphal Counselling is not a crisis service. If you are at immediate risk or need urgent mental health support, contact:

Where a serious and imminent risk is identified, Amanda Westphal Counselling may contact emergency services or request a welfare check without your consent, where reasonably necessary for your safety.

11. Communication Policy

Email and messaging are for administrative and reasonable support communication only. These channels are not emergency services and are not monitored around the clock.

Excessive, abusive, threatening or inappropriate communication may result in restricted access or termination of service.

12. Limitation of Liability

Counselling, group therapy, courses, training and all other materials are provided for educational and support purposes. No specific outcomes are guaranteed.

You remain responsible for your own decisions, wellbeing and actions. To the maximum extent permitted by law, Amanda Westphal Counselling excludes liability for indirect, incidental or consequential loss arising from use of these services.

13. Right to Refuse or Terminate Service

Amanda Westphal Counselling may suspend, refuse or terminate a service or a client's access without refund where a client:

  • breaches these terms
  • behaves abusively
  • breaches confidentiality
  • shares protected content unlawfully
  • disrupts the safety of a group or community
  • fails to meet payment obligations

14. Privacy Policy

Personal information collected through the website, booking system, payment provider and communication channels is used only for delivering services, administration, support and legal compliance. Reasonable steps are taken to protect your personal information in accordance with the Privacy Act 1988 (Cth).

15. Governing Law

These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.

16. Amendments

Amanda Westphal Counselling may update these terms at any time. Continued use of services after an update means you accept the revised terms.
