Confidentiality, Privacy Policy and Terms and Conditions

1. Client Agreement and Scope of Services
This agreement outlines the terms and conditions for counselling services, digital products, memberships, programs, and support services provided by Amanda Westphal Counselling.
By purchasing, booking, accessing, or participating in any service, membership, digital product, course, group program, or support offering, you acknowledge that you have read, understood, and agree to these terms.
All services are provided in accordance with applicable Australian laws and the ethical guidelines of the Australian Counselling Association (ACA).
2. Confidentiality and Privacy
All personal information and disclosures shared in counselling sessions are treated as confidential except where disclosure is required:

where there is an immediate risk of harm to yourself or another person
-
where disclosure is required by law, including mandatory reporting obligations
-
for professional supervision, with identifying details protected where possible
-
where emergency intervention is reasonably necessary for your safety
Confidentiality does not apply to community or group spaces where other participants are present. Members are expected to maintain the privacy of others.
3. Group Programs and Membership Community Rules
All participants in group calls, support circles, community memberships, and online forums must:

maintain the confidentiality of other members
-
not record sessions, calls, lives, workshops, or member discussions
-
communicate respectfully and professionally
-
not engage in bullying, harassment, discrimination, abuse, or harmful conduct
Any breach may result in immediate removal without refund.
4. Session Attendance, Booking and Cancellation
4.1 Standard Counselling Sessions
Clients must attend sessions on time.
If you do not arrive within 15 minutes of the scheduled start time, the session will be treated as a non-attendance and charged in full.
A minimum of 24 hours’ notice is required for cancellation or rescheduling.
Late cancellations and missed appointments are charged at the full session fee.
Emergency rescheduling may be offered at Amanda Westphal Counselling’s discretion.
4.2 PMDD Reset 1:1 Support Add-On
The PMDD Reset 1:1 Support Add-On is an additional paid service attached to the PMDD Reset Method membership.
This add-on includes one private 1:1 support session every fortnight while the subscription remains active and fully paid.
Member booking responsibility
It is solely the member’s responsibility to book each included session using the designated booking link or system.
Amanda Westphal Counselling is not responsible for reminding members to book sessions.
No rollover policy
Sessions included in each fortnightly period:
-
must be booked and attended within that fortnight
-
do not roll over into future periods
-
do not accumulate
-
cannot be transferred to another person
-
cannot be converted into refunds, credits, or cash value
Any unbooked or missed session is automatically forfeited at the end of that fortnight.
No make-up sessions will be provided unless required by law or approved at sole discretion.
Cancellation of add-on
Cancellation stops future billing only.
Unused sessions from previous billing periods remain forfeited and cannot be reinstated.
5. PMDD Reset Method Membership Terms
The PMDD Reset Method is a recurring digital membership program.
Membership may include:

course materials
-
digital resources
-
live sessions
-
support calls
-
group spaces
-
member-only community access
-
educational tools and frameworks
Membership access is personal to the paying member only.
Login credentials, access links, downloads, recordings, worksheets, and all member resources must not be shared.
Amanda Westphal Counselling reserves the right to modify membership inclusions, delivery format, schedules, and content at any time.
6. Payments, Failed Payments and Financial Responsibility
All fees are payable in AUD unless otherwise stated.
For subscriptions, memberships, and add-ons, you authorise recurring billing in line with your selected plan.
Failure of payment does not cancel your financial obligation.
If payment fails:

access may be suspended immediately
-
access to future sessions ceases
-
outstanding balances remain payable
-
collection action may be taken where necessary
You remain liable for all agreed instalments and payment plans.
7. Refunds and Consumer Rights
Due to the digital and service-based nature of memberships, programs, and digital products, refunds are not provided for change of mind.
This includes:

unused membership periods
-
missed live calls
-
forgotten bookings
-
unused 1:1 sessions
-
lack of engagement with materials
Refunds are only provided where required under Australian Consumer Law.
Nothing in these terms excludes your non-excludable rights under the Competition and Consumer Act 2010 (Cth).
8. Crisis and Emergency Support
Amanda Westphal Counselling is not a crisis service.

Where serious and imminent risk is identified, Amanda Westphal Counselling may contact emergency services or request a welfare check without consent where reasonably necessary.
9. Communication Policy
Email, WhatsApp, DMs, and messaging channels are for administrative and reasonable support communication only.
These channels are not emergency services.
Excessive, abusive, threatening, or inappropriate communication may result in restricted access or service termination.
10. Intellectual Property
All materials, frameworks, worksheets, course content, membership resources, branding, videos, recordings, methods, and educational systems including the PMDD Reset Method are the intellectual property of Amanda Westphal Counselling.
This includes proprietary frameworks, language, processes, and training resources.
You may not:

copy
-
reproduce
-
teach
-
resell
-
distribute
-
repurpose
-
create derivative products
-
share with clients or third parties
without prior written consent.
Any breach may result in immediate termination without refund and legal enforcement.
11. Limitation of Liability
All content, support, counselling, educational resources, and membership materials are provided for educational and support purposes.
No specific outcomes, medical results, emotional outcomes, or business outcomes are guaranteed.
You remain fully responsible for your own decisions, wellbeing, and actions.
To the maximum extent permitted by law, Amanda Westphal Counselling excludes liability for indirect, incidental, consequential, financial, emotional, or reputational loss arising from use of services or products.
12. Right to Refuse or Terminate Service
Amanda Westphal Counselling reserves the right to suspend, refuse, or terminate services, membership access, or participation without refund where a client or member:

breaches these terms
-
behaves abusively
-
breaches confidentiality
-
shares content unlawfully
-
disrupts the safety of the community
-
fails to meet payment obligations
13. Privacy Policy
Personal information collected through the website, booking systems, payment providers, memberships, and communication channels is used only for service delivery, administration, support, and legal compliance.
Reasonable steps are taken to protect personal information in accordance with the Privacy Act 1988 (Cth).
14. Governing Law
These terms are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
15. Amendments
Amanda Westphal Counselling may update these terms at any time.
Continued use of services after updates constitutes acceptance of the revised terms.
